These Terms of Service ("Terms") govern your access to and use of the GetClinic platform, website, and related services ("Services") provided by Intellicons Technology Ltd (Company No: 17267394), a company registered in England and Wales, operating the GetClinic platform ("GetClinic", "we", "us"). By registering for or using our Services, you agree to these Terms in full.
These Terms constitute a legally binding agreement between you (the "Prescriber", "Clinic", or "User") and Intellicons Technology Ltd (trading as GetClinic). If you are registering on behalf of a clinic or organisation, you warrant that you have authority to bind that entity.
To use the GetClinic prescribing platform you must:
GetClinic reserves the right to verify credentials, request supporting documentation, and suspend or terminate accounts where eligibility cannot be confirmed or is revoked by a regulatory body.
GetClinic provides the following services through the platform:
GetClinic is a software platform and technology service provider. It does not provide medical advice, diagnoses, or clinical services, and does not employ prescribers to provide clinical care.
As a registered prescriber using GetClinic, you are solely and exclusively responsible for:
GetClinic's AES system constitutes a valid Advanced Electronic Signature under the Electronic Communications Act 2000. You acknowledge that your use of your prescriber PIN constitutes your electronic signature and that you are solely responsible for all prescriptions signed with your credentials.
You warrant that your use of the platform will at all times comply with:
Prohibition on advertising prescription medicines: You must not use the platform or any GetClinic-generated content to advertise prescription-only medicines (POMs) to the public. The promotion of POMs to the general public is prohibited under the Human Medicines Regulations 2012. Any patient-facing communications must comply with this restriction.
Where your clinical activities using this platform constitute a "regulated activity" as defined under the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 — including but not limited to the treatment of disease, disorder or injury, or the provision of advice or treatment for the purposes of physical or mental health — you are required to be registered with the Care Quality Commission (CQC) as a service provider.
Intellicons Technology Ltd is a software platform provider and is not registered with the CQC as a provider of regulated clinical activities. Each clinic or prescriber using the platform to provide regulated activities is individually responsible for obtaining and maintaining their own CQC registration.
GetClinic offers the following subscription tiers, all prices in GBP exclusive of VAT:
Pricing is subject to change with 30 days' written notice. Subscriptions on paid tiers renew automatically on a monthly basis unless cancelled. Cancellation requests must be made at least 24 hours before the renewal date.
All fees are exclusive of VAT. GetClinic will charge VAT where applicable under UK tax law.
Important notice on commercial arrangements and clinical independence: GetClinic's pricing is a software platform fee. It is not a fee-splitting arrangement, referral fee, or inducement to prescribe. GetClinic's pricing structure must not influence your clinical decisions. Your prescribing decisions must at all times be made solely on clinical grounds in the best interests of your patient, in accordance with GMC Good Medical Practice, GPhC Standards for Pharmacy Professionals, and applicable regulatory guidance.

Both parties acknowledge their obligations under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. GetClinic acts as a Data Processor for patient clinical data entered by prescribers, who act as Data Controllers. For platform account and operational data, GetClinic acts as Data Controller.
A Data Processing Agreement (DPA) is incorporated into these Terms by reference and is available at getclinic.io/dpa or on request at compliance@getclinic.io. The DPA governs the processing of personal data on behalf of prescribers.
Special category health data is processed under Article 9(2)(h) UK GDPR — processing for medical purposes by healthcare professionals subject to professional secrecy obligations.
All platform software, designs, content, trademarks, and branding are the exclusive property of Intellicons Technology Ltd. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the platform solely for its intended lawful purpose during your subscription period. You may not copy, modify, reverse-engineer, decompile, or redistribute any part of the platform.
Clinical records and patient data entered by you remain your property and your patients' property. GetClinic does not claim ownership of clinical content you create on the platform.
To the maximum extent permitted by applicable law, Intellicons Technology Ltd shall not be liable for:
Our total aggregate liability for any claim arising under or in connection with these Terms shall not exceed the total subscription fees paid by you to GetClinic in the three (3) months immediately preceding the event giving rise to the claim.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
You agree to indemnify, defend, and hold harmless Intellicons Technology Ltd, its directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your breach of any professional regulatory obligation; (c) any clinical decision or prescription issued by you through the platform; (d) your infringement of any third party's rights.
Either party may terminate a paid subscription with 30 days' written notice. The FREE plan may be terminated by either party at any time without notice. GetClinic may suspend or terminate your account with immediate effect, without refund, for:
Upon termination, you may request an export of your clinical data within 30 days. After 30 days, data will be retained only as required by applicable law and our retention policy.
If you have a complaint about the GetClinic platform or our services, please contact us in the first instance at support@getclinic.io. We will acknowledge your complaint within 3 working days and aim to resolve it within 28 calendar days. If you remain dissatisfied, you may seek independent resolution through the courts of England and Wales as set out in clause 15 below.
For patient complaints relating to clinical care, prescribing decisions, or professional conduct, these should be directed to the relevant prescriber directly and, if unresolved, to their regulatory body (GMC, GPhC, NMC, or CQC as appropriate). GetClinic is a software platform and is not responsible for clinical decisions made by prescribers using the platform.
GetClinic targets a platform availability of 99.9% uptime, measured monthly, excluding scheduled maintenance. In the event of unplanned downtime affecting clinical workflows, we will communicate status updates via our status page and by email. You are responsible for maintaining contingency arrangements to ensure continuity of patient care in the event of platform unavailability. GetClinic shall not be liable for clinical harm arising from platform unavailability where reasonable contingency arrangements have not been made.
GetClinic may amend these Terms at any time. We will provide 30 days' written notice of material changes. Continued use of the platform after the effective date of amendments constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be referred to the exclusive jurisdiction of the courts of England and Wales.
